These Terms of Service ("Terms," "Agreement") constitute a legally binding contract between you ("User," "you," or "your") and Planviah Helgesen, a Norwegian sole proprietorship ("Company," "we," "us," or "our") regarding your access to and use of the Planviah mobile application (the "Application" or "App") and our website located at www.planviah.com (the "Website"). The Application contains all functional features and services, while the Website serves as a landing page and marketing platform. Collectively, the Application and Website are referred to as the "Services."
By downloading, installing, accessing, or using our Services in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you are expressly prohibited from using our Services and must discontinue use immediately.
These Terms apply to all users of our Services, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content. Your use of our Services is also governed by our Privacy Policy, which is incorporated herein by reference.

Planviah is a comprehensive digital platform specifically designed to support students in achieving academic success, maintaining mental well-being, and developing essential life skills. Our Application encompasses a wide range of functional features and capabilities, including but not limited to goal setting and tracking mechanisms, habit formation and monitoring tools, financial literacy education and expense tracking capabilities, focus enhancement techniques and productivity methodologies, stress management resources and mental health support materials, and artificial intelligence-powered assistance and guidance.
Our Website serves primarily as an informational and marketing platform, providing details about the Application's features, company information, support resources, and promotional content. The Website does not contain the functional tools and features available within the Application.
Our Services are designed to complement, not replace, professional academic counseling, mental health services, or financial advisory services. The content and features provided through our Application are intended for educational, informational, and motivational purposes and should not be construed as professional advice in any specialized field.
We reserve the right to modify, enhance, or discontinue any aspect of our Application or Website at our sole discretion, with or without notice, except as otherwise specified in these Terms or required by applicable law.
4. Eligibility and User Requirements
4.1 Age and Legal Capacity
To use our Services, you must be at least thirteen (13) years of age. While our Services are primarily designed for students aged eighteen (18) and above, users between the ages of thirteen (13) and seventeen (17) inclusive may access our Services provided they have obtained verifiable parental or legal guardian consent where required by applicable law in their jurisdiction.
You represent and warrant that you possess the legal right and capacity to enter into this Agreement and to use our Services in accordance with these Terms. If you are using our Services on behalf of an organization or entity, you represent and warrant that you have the authority to bind such organization or entity to these Terms.
4.2 Account Registration and Authentication
Access to the functional features of our Application requires the creation of a user account through one of our approved authentication methods. The Website may be accessed without registration for informational purposes. We currently support account creation for the Application through Apple Sign-In integration or traditional email-based registration. During the Application registration process, you will be required to provide certain personal information, including but not limited to your full legal name, valid email address, telephone number, and date of birth.
You acknowledge and agree that all information provided during Application registration and throughout your use of the Application must be accurate, complete, current, and truthful. You are solely responsible for maintaining the accuracy and completeness of your account information and for promptly updating such information when changes occur.
4.3 Account Security and Responsibility
You are entirely responsible for maintaining the confidentiality and security of your account credentials, including your username, password, and any authentication tokens or keys. You agree to immediately notify us of any unauthorized use of your account or any other breach of security that comes to your attention.
You acknowledge that you are solely liable for all activities that occur under your account, whether authorized by you or not, until you notify us of unauthorized access and we have had a reasonable opportunity to act upon such notice. You may not permit others to use your account or share your account credentials with any third party. The creation of multiple accounts by a single individual is strictly prohibited.
5. Service Tiers, Subscriptions, and Payment Terms
5.1 Service Offerings
Our Application is provided through a freemium model consisting of two primary tiers. Our free tier provides access to basic Application functionality with certain limitations on features, usage, and content access as specified within the Application. Our premium subscription tier offers comprehensive access to all Application features, unlimited usage of core functionalities, priority customer support, and access to exclusive content and tools.
5.2 Subscription Terms and Billing
Premium subscriptions are offered on a recurring basis with billing cycles as specified during the subscription process. All subscription fees are charged in advance for the applicable billing period and are non-refundable except as expressly provided in these Terms or as required by applicable consumer protection laws.
Subscriptions automatically renew at the end of each billing period unless you cancel your subscription prior to the renewal date. Renewal charges will be processed using the payment method associated with your account. It is your responsibility to ensure that your payment information remains current and valid.
5.3 Payment Processing and App Store Integration
All subscription transactions are processed through the Apple App Store in accordance with Apple's Terms of Service and applicable payment policies. We do not directly process or store credit card information or other payment details. All billing disputes, refund requests, and payment-related issues must be directed to Apple through your App Store account settings.
5.4 Price Modifications
We reserve the right to modify our subscription pricing at any time. Price changes will be communicated to existing subscribers no less than thirty (30) days prior to the effective date of such changes through in-app notifications, email communications, or other reasonable means. Your continued use of our Services after a price change becomes effective constitutes your acceptance of the new pricing structure.
6. User Conduct and Acceptable Use
6.1 Permitted Uses
You may use our Services solely for lawful, personal, non-commercial purposes in connection with legitimate educational activities, personal development goals, and productivity enhancement. The Application is designed for personal productivity and educational use, while the Website is intended for informational purposes. Your use of our Services must comply with all applicable local, national, and international laws, regulations, and ordinances.
6.2 Prohibited Conduct
You expressly agree not to engage in any of the following prohibited activities: violating any applicable laws, regulations, or third-party rights; providing false, misleading, or inaccurate information during Application registration or in connection with your use of our Services; impersonating any person or entity or falsely stating or misrepresenting your affiliation with any person or entity; interfering with, disrupting, or creating an undue burden on our Application, Website, or the networks or systems connected to our Services; attempting to gain unauthorized access to our Application, Website, other user accounts, computer systems, or networks through hacking, cracking, or any other illegitimate means; using our Application or Website for any commercial purpose or for the benefit of any third party without our express written consent; reverse engineering, decompiling, disassembling, or otherwise attempting to discover the source code or underlying algorithms of our Application; removing, altering, or obscuring any proprietary notices, labels, or marks on our Services; using automated systems, including but not limited to robots, spiders, scrapers, or similar technologies to access our Services; transmitting or uploading any content that contains viruses, malware, or other harmful computer code; or engaging in any activity that could damage, disable, overburden, or impair the proper functioning of our Services.
6.3 Enforcement and Remedies
We reserve the right, but are not obligated, to monitor user activity and content for compliance with these Terms. Upon discovery of any violation, we may take appropriate action in our sole discretion, including but not limited to issuing warnings, suspending or terminating user accounts, removing content, or pursuing legal remedies.
7. Artificial Intelligence Features and Limitations
7.1 AI Integration and Functionality
Our Application incorporates artificial intelligence capabilities powered by OpenAI's application programming interface. These AI features are designed to provide personalized recommendations, educational content, motivational guidance, and interactive assistance to enhance your user experience and support your academic and personal development goals within the Application.
7.2 AI Accuracy and Reliability Disclaimer
You acknowledge and understand that AI-generated content and responses are produced through automated algorithms and machine learning processes. While we strive to provide accurate and helpful information, AI systems are inherently limited and may produce incorrect, incomplete, biased, or inappropriate responses. You should not rely solely on AI-generated advice for important personal, academic, financial, or health-related decisions.
7.3 User Responsibility for AI Interactions
You are solely responsible for evaluating the accuracy, completeness, and appropriateness of any AI-generated content or recommendations before acting upon such information. Important Notice: Planviah does not provide, and is not licensed to provide, professional financial, investment, tax, or legal advice. All financial content, tools, calculators, and educational materials provided through our Application are for general informational and educational purposes only. Such content should not be construed as personalized financial advice or recommendations tailored to your specific financial situation.
8.3 Independent Financial Decision-Making
You acknowledge that any financial decisions you make are entirely your own responsibility. We strongly recommend consulting with qualified financial advisors, certified public accountants, or other licensed professionals before making significant financial decisions. We expressly disclaim any responsibility or liability for financial losses, missed opportunities, or adverse consequences resulting from your reliance on information or tools provided through our Application.

We make no representations, warranties, or guarantees regarding any financial outcomes, savings achievements, investment performance, or other financial results that may or may not result from your use of our Application. Past performance, hypothetical examples, and educational scenarios do not guarantee future results.
9. Mental Health Support and Crisis Intervention Disclaimers

Critical Notice: Planviah is not a healthcare provider and does not provide professional mental health services, psychological counseling, therapy, or crisis intervention. Our Application's mental health features are designed for educational, motivational, and self-help purposes only. If you are experiencing mental health difficulties, we strongly encourage you to seek assistance from qualified mental health professionals.
9.3 Crisis Intervention and Emergency Situations
Emergency Disclaimer: Our Application is not equipped to provide crisis intervention or emergency mental health support. If you are experiencing a mental health emergency, thoughts of self-harm, or suicidal ideation, please immediately contact emergency services or crisis intervention resources in your area.
For users in Norway, emergency services can be reached at 112 or 113. Additional crisis support resources include the Mental Health Crisis Helpline and local mental health emergency services. For users in other countries, please contact your local emergency services or mental health crisis hotlines.
9.4 Limitation of Mental Health Support
While our Application may provide general wellness support and educational content related to stress management and mental health awareness, such features should never be used as a substitute for professional diagnosis, treatment, or therapeutic intervention. We are not responsible for any adverse outcomes resulting from reliance on our Application's mental health features in lieu of professional care.

We are not responsible for any service interruptions, data loss, or other issues resulting from third-party service failures or modifications.

While our Application does not currently provide functionality for users to share content with other users, any data, information, or content you create, input, or generate while using our Application remains your property. However, by using our Application, you grant us a worldwide, royalty-free, non-exclusive license to use, process, and analyze such content solely for the purposes of providing, maintaining, and improving our Application.

Our mobile application is currently available exclusively for iOS devices through the Apple App Store. Your use of our Application is subject to Apple's App Store Terms of Service and related policies. We reserve the right to expand to additional platforms in the future but make no commitments regarding such expansion.
13.2 Internet Connectivity Requirements
Our Services require a stable internet connection for full functionality. Certain features may be unavailable or limited when internet connectivity is poor or unavailable. We do not currently offer offline functionality, and all data synchronization occurs in real-time through our servers.
13.3 Device and System Requirements
To use our Application effectively, you must maintain a compatible iOS device with a supported operating system version as specified in the App Store listing. You are responsible for ensuring that your device has sufficient storage capacity, processing power, and memory to support the proper functioning of our Application.
13.4 Updates and Maintenance
We regularly release updates to our Application to introduce new features, improve performance, enhance security, and address technical issues. Updates are distributed through the Apple App Store, and you are encouraged to install updates promptly to ensure optimal performance and security.
14. Affiliate Marketing and Partnership Disclosure

In accordance with applicable advertising and consumer protection laws, we disclose that our Application and Website may include affiliate marketing relationships with third-party companies, products, or services. Our Services may be temporarily unavailable due to scheduled maintenance, system upgrades, server failures, network issues, or other technical difficulties beyond our reasonable control.

We will make reasonable efforts to provide advance notice of scheduled maintenance that may significantly impact Application or Website availability. Such notices will be provided through in-app notifications, email communications, or announcements on our Website, depending on the nature and duration of the expected service interruption.
15.3 Service Modifications and Enhancements
We reserve the right to modify, enhance, suspend, or discontinue any aspect of our Application or Website at any time without prior notice, except where such notice is required by law or these Terms. This includes the right to change Application features, alter functionality, update content, or implement new technical requirements.
15.4 Communication of Changes
Material changes to our Application or Website that significantly impact user experience or functionality will be communicated to users through appropriate channels, including in-app notifications, email announcements, or updates to our Website. We encourage users to review such communications regularly to stay informed about service changes.
16. Account Termination and Suspension
16.1 User-Initiated Termination
You may terminate your account and discontinue use of our Application at any time by contacting our customer support team at support@planviah.com or through account settings within the Application where such functionality is available. Upon termination, your access to premium Application features will cease immediately, though you may retain access to free tier features subject to these Terms. The Website remains accessible for informational purposes regardless of account status.
16.2 Subscription Cancellation
Premium subscription cancellations must be processed through your Apple App Store account settings in accordance with Apple's subscription management procedures. We do not have the ability to directly cancel App Store subscriptions on your behalf.
16.3 Company-Initiated Termination
We reserve the right to suspend, restrict, or terminate your access to our Application immediately and without prior notice if we determine, in our sole discretion, that you have violated these Terms, engaged in fraudulent or illegal activities, or otherwise misused our Application in a manner that could harm other users or our business operations. Termination of Application access does not affect your ability to view our Website for informational purposes.
16.4 Effect of Termination
Upon termination of your account, whether initiated by you or by us, your right to access and use our Application will cease immediately. We may, but are not obligated to, delete your account data and personal information in accordance with our Privacy Policy and applicable data retention laws. Termination does not relieve you of any obligations or liabilities that accrued prior to termination.
17. Disclaimers and Limitation of Liability
17.1 Service Disclaimer
OUR APPLICATION AND WEBSITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND COURSE OF DEALING.
17.2 No Guarantee of Accuracy or Completeness
WE DO NOT WARRANT THAT OUR APPLICATION OR WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, TIMELINESS, OR RELIABILITY OF ANY CONTENT, INFORMATION, OR SERVICES PROVIDED THROUGH OUR APPLICATION OR WEBSITE.
17.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PLANVIAH HELGESEN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, OR USE, REGARDLESS OF THE THEORY OF LIABILITY AND WHETHER WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
17.4 Maximum Liability Cap
IN ANY EVENT, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR APPLICATION OR WEBSITE SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO US, IF ANY, DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
17.5 Jurisdictional Limitations
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, OUR LIABILITY WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
18. Governing Law and Dispute Resolution
18.1 Applicable Law
These Terms and your use of our Services shall be governed by and construed in accordance with the laws of Norway, without regard to conflict of law principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
18.2 Jurisdiction and Venue
Any legal action or proceeding arising out of or relating to these Terms or your use of our Application or Website shall be instituted exclusively in the competent courts of Norway. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.
18.3 Consumer Protection Rights
These Terms do not limit any rights you may have as a consumer under applicable consumer protection laws. If you are a consumer, certain mandatory consumer protection laws may apply to your use of our Application or Website regardless of the governing law clause above.
18.4 Alternative Dispute Resolution
Before initiating formal legal proceedings, we encourage you to contact us directly to attempt to resolve any disputes amicably. We are committed to working with users to address concerns and resolve issues in a fair and reasonable manner.
19. Force Majeure
We shall not be liable for any failure to perform our obligations under these Terms when such failure results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, epidemic or pandemic events, internet service provider failures, or denial of service attacks. In such circumstances, we will make reasonable efforts to minimize service disruptions and to resume normal operations as quickly as possible.
20. Severability and Enforceability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severed from these Terms, and the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely approximates the intent and economic effect of the original provision.
21. Entire Agreement and Amendment
These Terms, together with our Privacy Policy and any additional terms referenced herein, constitute the entire agreement between you and Planviah Helgesen regarding your use of our Application and Website and supersede all prior or contemporaneous communications, agreements, and understandings, whether written or oral, relating to the subject matter hereof.
We reserve the right to modify these Terms at any time in our sole discretion. Material changes will be communicated to users through in-app notifications, email communications, or prominent notices on our Website at least thirty (30) days prior to the effective date of such changes, except where immediate changes are necessary for legal compliance or security reasons. Your continued use of our Application or Website after any modification constitutes your acceptance of the modified Terms.
22. Assignment and Transfer
You may not assign, transfer, or delegate any of your rights or obligations under these Terms without our prior written consent. We may freely assign or transfer these Terms and our rights and obligations hereunder to any third party without restriction or notification.
23. Waiver
Our failure to enforce any provision of these Terms or to exercise any right available to us shall not constitute a waiver of such provision or right unless acknowledged and agreed to by us in writing. Any waiver of these Terms by us must be express and in writing and shall not constitute a waiver of any other provision or any subsequent breach.
